It is extremely important to Mustang Sportswear that your personal data are managed in a safe and secure way. We comply with legislation and the regulations applicable to the protection of personal data. This Privacy Policy is designed to help you understand the type of information we collect and the way in which it is used. You are always welcome to contact us if you should have questions or concerns about how we manage your data.

Mustang Sportswear ApS, hereinafter referred to as ‘Mustang Sportswear’ is the data controller responsible for the processing of the collected personal data. Mustang Sportswear can be contacted either by post or by e-mail.

PROCESSING OF PERSONAL DATA

The way in which personal data are managed and processed depends on whether you are logged in using your profile or whether you are visiting the web shop without providing personal details. Processing details can be found below.

Information used for orders and purchases:

Collection and processing of personal data takes place on the basis of the regulations contained in the Danish Sale of Goods Act. Without this information, we cannot fulfil our contract with you. Information is stored for three (3) years, which is the general limitation period in accordance with the Danish Statute of Limitations Act, from the date the order is delivered and paid. By storing the information, we have the opportunity to assist at a later date if you should have any questions about claims and warranty issues.

With your consent, the web shop is able to store your card details with Mustang Sportswear’s payment solutions provider. The legal basis is consent, cf. the Data Protection Act, section 6, subsection. 1. By saving card information, return visits to the web shop will be optimised for the benefit of your user experience. Your consent may be withdrawn at any time.

The data below will be processed:

  • Name
  • Address
  • Processing information and payment history
  • Information about your order (e.g. order number, product and delivery address)

 

To ensure an optimum customer experience, Mustang Sportswear processes the information listed below:

  • Name
  • Telephone number and e-mail
  • Payment information and payment history
  • Information about your order (e.g. order number, product, delivery address and invoice)
  • Information that you yourself provide in your communication with Mustang Sportswear

Your personal data are stored as long as required and as long as a legitimate purpose in the context of meeting our contractual and legal obligations exists. Your personal data may further be stored for other purposes as long as this is required by law as well as in the context of any legal claims. The legal basis for this is the Data Protection Act § 6, para. Article 6 (1) with reference to the Data Protection Regulation 1, letter f.

 

To be able to market and offer a personalised web shop:

We collect the following information for the purposes of providing a personalised web shop focusing on individual needs and preferences.

To determine who visits our web shop, we use cookies to analyse and subsequently provide suggestions for other products you might be interested in in our web shop. Cookies are used with your consent which you provide when you accept cookies on entry to the web shop. We store such data for a maximum of twelve (12) months from your most recent activity or until you withdraw your consent. You can request to have the collected information deleted at any time.

Marketing
We use personal information in connection with marketing initiatives, including to be able to target our communication to you. The targeted communication includes sending out newsletters.
For this purpose, we only process ordinary personal information, including name and email.
The personal information we use comes from you. The information can also be obtained through the use of our website.
The legal basis for processing the data follows from Article 6 (1) of the Data Protection Regulation. 1, letter f. The legitimate interests are Mustang Sportswear’s marketing interest and our interest in targeting the material we broadcast. We do not pass on your personal information to third parties.
If you have signed up for our newsletters, we will store your personal information for as long as you wish to receive material from us and for two years thereafter.
The newsletter can always be deselected by clicking on “Unsubscribe” at the bottom of the email with which the news is sent.

Prevention of misuse

To prevent misuse and to prevent and counter offences against Mustang Sportswear, the following information is collected and processed:

  • Name
  • Address, telephone number and e-mail
  • Payment information (e.g. repeated, incorrectly entered account information etc.)
  • Information about returns and deliveries
  • IP address
  • Customer notes, if any
  • Customer service history

 

Mustang Sportswear has a legitimate interest in processing and storing information to prevent misuse of the web shop
The information is stored as long as it is relevant, but information about the action that justifies collection and processing is generally held for 36 months.

 

Analysis and development of the web shop

For the purpose of analysis and development of the Mustang Sportswear web shop, the following information is collected and processed:

  • Purchase- and user-generated data (e.g. click and visit history, login information, time registration etc.)
  • Technical data relating to devices, settings (e.g. language, IP address, browser settings, time zone, operating system etc.)

 

The collection and processing of the data is necessary in order to provide a well-developed web shop offering an optimum user experience for the benefit of you, the customer. The collection and data processing takes place at a general and anonymised level at which it is not possible to attribute information to any individual user/customer. It will therefore not be possible at a later date to gain insight into or delete collected information.

Information provided when setting up a profile

To make it easier to shop in the web shop, visitors are offered the option of registering as a user/returning customer. Personal data are provided as is consent to collect and process such information.

  • Name
  • Address, telephone number and e-mail
  • Information and history about all your orders such as order number, product, delivery address, invoice etc.
  • Information about your return history and any return notes
  • Data collected from cookies etc.

 

The information is automatically deleted 36 months after the most recent activity on your personal profile or if you require the information to be deleted, including your profile.

DISCLOSURE OF DATA

We share information from time to time with system providers in order to perform processing as described in the previous sections. Information collected and processed by Mustang Sportswear will never be sold to others unless you have previously given your express consent to such sale.

Service providers

Your personal data are shared with companies that provide services, which may be e.g. managing the shipping and delivery of your goods or certain systems. Companies that have been given access to personal data may only process these on the basis of our express instructions.

Payment service providers

Payments made in the web shop are managed by external providers who are independent data controllers for their own processing of the personal data provided by you. These providers have separate terms that apply to them and further information about terms etc. is offered when you select the payment method in the web shop.

 Traffic-generating partners

Information, such as order number and purchase price, is shared with the partners who direct traffic to the web shop. This information is not sold or redistributed by the partners.

 Other recipients of personal data

In other cases, we may be required, in accordance with the law, to disclose information to government authorities. Information may be disclosed if Mustang Sportswear becomes the subject of an acquisition. Any disclosure of such information will be subject to strict terms under a non-disclosure agreement.

Transfer to countries outside the EU

If service and payment service providers are located outside the EEA, data will only be transferred if there is legal authority to do so.

 

YOUR RIGHTS

As a customer, you have a number of inalienable rights regarding the use of personal data pursuant to the General Data Protection Regulation.

Article 15 – the right of access

You have the right to access the personal data that we process about you with certain exclusions as specified in legislation.

In certain circumstances, you have the right to receive the data we have recorded about you in a structured, commonly used and machine-readable format and to request that we transmit this information to another data controller.

When requesting your personal data, please contact customer service, who will give you access to your personal data within 30 days in a commonly used electronic form.

Article 21 – the right to object

You may at any time object to the collection and further processing of your personal data for special purposes as well as to the processing of your personal data for direct marketing purposes.

Personal data can help to provide an optimised user experience in the web shop. If you do not want this, you are encouraged not to log in. When you are not logged in, only the required cookies (www.mustang-sportswear.dk/cookies)  are collected (link to cookies) and no link will be made to data that you have provided and which may be personally attributable to you. Previous history will not be available.

If you object to the processing of your personal data for direct marketing purposes, you will no longer be able to use mustang-sportswear.dk as a user, but if Mustang Sportswear is under obligation or entitled to continue the processing in accordance with legislation, we reserve the right to do this.

Your objection does not affect the lawfulness of the processing that took place before your withdrawal of consent.

Article 16 – the right to rectification

If the information we have registered about you is incorrect, you can have it corrected by contacting us.

 

Article 17 – the right to erasure and to be forgotten

If you request it, we will delete the personal data we have registered about you without undue delay, unless we can continue processing on another basis. A refusal to erase may be necessary e.g. to be able to determine or assert a legal claim, or if it is required in order to respond to an enquiry from you.

Personally identifiable data are deleted as soon as possible, but within thirty (30) days. Data collected about purchases and behaviour will be anonymised and will not be personally attributable to you.  We will retain some data such as invoices in accordance with the Danish Accounting Act and other legal considerations for a period of five (5) years from the end of the financial year to which the material relates.

Your profile will be removed within thirty (30) days of your request to have your personal data deleted. It will then no longer be possible to use the features of the web shop.

Article 18 – the right to restriction

You have the right to ask us to limit the processing of your personal data instead of initiating a complete erasure of the personal data collected by you.

Enquiries and complaints about your rights

In order to process enquiries and complaints from you, it is important that you have provided us with sufficient information, including your full name and e-mail address, so that you can be identified and the request processed. Enquiries are processed continuously. It takes a maximum of up to thirty (30) days for you to receive a response. In the event of disagreements that cannot be resolved between the parties, we refer you to the Danish Data Protection Agency.
