IMPORTANT NOTICE ON SALES AND DELIVERY TERMS AND CONDITIONS
The Sales and Delivery Terms and Conditions below apply when purchases are made from the web shop. When you make a purchase from the web shop, you simultaneously accept our Sales and Delivery Terms and Conditions and enter into an agreement with Mustang Sportswear on delivery of your purchase (hereinafter referred to as ‘the Agreement’). It is a condition that the Sales and Delivery Terms and Conditions are accepted before a purchase from the web shop can be made. As the Sales and Delivery Terms and Conditions exist to reflect applicable legislation and rules, you are asked to accept the Sales and
Delivery Terms and Conditions every time you purchase an item from the web shop. The Sales and Delivery Terms and Conditions that you accept when you place an order are the Sales and Delivery Terms and Conditions that apply to your order or orders.
LEGAL RIGHT OF CANCELLATION WHEN PURCHASING ITEMS FROM THE WEB SHOP
You always have the right to cancel this Agreement within fourteen (14) days without giving a reason. The fourteen-day right of cancellation constitutes fourteen (14) full days and runs from the day you, or a person designated by you (but not the supplier), received the last of your items. To exercise your right of cancellation, please notify Mustang Sportswear, Bakkegårdsvej 211, DK-3050 Humlebæk, Denmark on the following e-mail firstname.lastname@example.org or by post or fax of your decision to cancel the Agreement. If you submit your cancellation form online, we will send you a receipt immediately (e.g. by e-mail). You are deemed to have complied with the cancellation period if you submit the return form before the period of the fourteen (14) days expires.
Effects of the right of cancellation
If you terminate your Agreement by exercising your right of cancellation, we are under obligation to refund all payments we have received from you, including delivery costs (except any costs associated with your choice of delivery method that is not the standard delivery that we offer), without undue delay and at the latest within fourteen (14) days from the day we received your notice of cancellation of the Agreement. Refunds will be paid to you using the same payment method that you used for the original purchase unless we have expressly agreed with you that another refund method is possible. We do not charge any refund fees. However, we will withhold your refund until we have received the refunded items or until you have provided us with proof that you have returned the items in question, whichever occurs first. Orders must be returned without undue delay and within fourteen (14) days of your notification that you wish to cancel the Agreement. The above conditions are considered fulfilled if you return the items in question within fourteen (14) days. We will reimburse the shipping costs provided that you use the enclosed return documents for shipping in the country to which you received your items. Otherwise you will have to pay the shipping costs yourself. You are only under obligation to bear the costs of any impairment of the items if the impairment is due to your incorrect handling of the items during examination of the condition, property and function of the items.
Exceptions to the right of cancellation apply to the delivery of sealed items which, for health protection or hygiene reasons, are not suitable for return and where the seal has been broken after delivery.
Agreements on purchase and orders can only be entered into via the web shop. By placing an order, you declare that you are acting as a private individual for private purposes. Orders sent by e-mail, post or otherwise are not processed, but you are referred to the web shop. To purchase from the web shop, you confirm that you are at least 18 years old and that you have a valid credit card that is accepted as a means of payment by the web shop.
By clicking ‘Send order and pay’, you place a binding order for the items in your shopping cart. We will send you an order confirmation by e-mail as soon as you submit your order. A binding agreement will only have been entered into when you have received an order confirmation from us. The order confirmation is deemed to have been received as soon as we have sent it to the e-mail address that you have registered on your web-shop account and at check-out and when this e-mail has reached your e-mail provider’s server. The terms of the Agreement will be stored with Mustang Sportswear and will be available under ‘My page’ at www.mustang-sportswear.dk. Please note that items ordered by prepayment (reserved payment) will be dispatched as soon as the full purchase price as well as any delivery costs have been received. Therefore, we ask that you transfer the full purchase price of your order as soon as you receive your order confirmation and within seven (7) days.
By completing your purchase, you accept that we are entitled to transfer our rights and obligations under the Agreement entered into to third parties. The transfer is, of course, conditional on the standard of the service received not being reduced. Notification of a possible transfer will always be given. The acceptance of transfer is also an acceptance that your rights can only be asserted against the third party in question.
Mustang Sportswear is not under obligation to deliver your order in the unlikely event that our suppliers do not deliver to our warehouse irrespective of whether we have followed correct ordering practice (corresponding procurement transaction). In order for this exclusion to apply, it is a condition that we are not legally responsible for the availability of the items in question and that we must have informed you of the situation without undue delay.
The order is only fulfilled if the delivery address is a home address or a business address specified by the customer in one of the countries to which delivery is made. Delivery cannot therefore be made to PO boxes.
The right to cancel the Agreement, including the purchase, without incurring compensation or other costs in one of the situations specified below:

When you purchase from the web shop, Mustang Sportswear handles the payment and retains the right to reject certain payment methods for a given order and to refer to other payment methods. If you have any questions regarding payment, please contact Mustang Sportswear.
All prices are in Danish kroner and include VAT. All expenses in relation to the item, including postage, shipping, packaging etc., as well as a total price, will appear when ordering and will be shown in the order confirmation.
Delivery costs will vary depending on the item and delivery method you have chosen. If you buy multiple items, all items will as a rule be sent in the same delivery and you will only be charged for delivery once.
You will be able to choose between the payment methods that we offer during the purchase process. In order to minimise the risk of unauthorised access, your payment card information is encrypted. Once we have received your order, we will reserve the amount via the chosen payment method to ensure that there is coverage for the purchase price so that the transaction can be completed.
Amounts will only be debited from your card when the item is shipped. This means that your payment card is charged every time an order is sent. However, you will never have to pay more than the total amount for which you have ordered and made purchases.
You must cover any costs related to money transactions.
We reserve the right to charge a fee of DKK 100 for late payment per payment reminder if you fail to meet your payment obligations. You have the right to provide evidence that the actual loss was significantly less than the stated fee or that we did not suffer any loss. You agree to receive invoices and credit notes exclusively in electronic form.
SETTING UP A WEB SHOP ACCOUNT
When you make a purchase from the web shop, it will be possible to create an account so that in the future you are able to log in quickly or you can purchase from the web shop without creating an account.
All personal data stored on the site is processed as securely as possible. The stored information is not sold or used for purposes other than to provide the best possible service. The information will only be used to inform you about special offers as well as marketing initiatives related to Mustang Sportswear. When registering with the web shop, you have the option to opt out of receiving information from Mustang Sportswear. If you want to unsubscribe from news, edit your account settings or send an e-mail to email@example.com. Please provide your full name and e-mail as well as a short description of the nature of your enquiry in the e-mail. You are entitled at any time to request to see and receive a list of the data we hold about you. This can be done by contacting firstname.lastname@example.org. Of course, if data is incomplete or incorrect, you are entitled to have it corrected.
THE LANGUAGE OF THE AGREEMENT
This Agreement has been entered into in Danish.
MEANS OF PAYMENT
The web shop accepts the following means of payment.
CREDIT CARD VERIFICATION CODE
If you pay by credit card, you will be asked to enter the card’s card number and expiry date as well as credit card verification code (CVC). You will find the three digits on the back of your credit card, most often on the right side of the back of the credit card. This code is required for the payment to be completed and to maintain a high level of security. We may apply similar additional security measures.
When your items leave our warehouse for delivery, your payment will be debited from your chosen means of payment.
All the prices listed in the web shop for items, delivery costs and other costs are inclusive of taxes, VAT and fees. Costs related to delivery, shipping and postage may vary for each order. Mustang Sportswear has entered into an agreement with Shipmondo which handles shipping and shipping prices, which will appear on the payment page.
Standard delivery time to addresses in Denmark is 1-3 days. Track your package using the tracking number sent to you.

If you live in Europe, delivery time is typically 4-5 days, while shipments to countries outside Europe typically take 6-8 days to arrive. Please note that shipments to countries outside the EU may be delayed at customs and may be subject to customs duties and VAT during delivery.
PLEASE NOTE: Orders delivered to countries outside the EU’s tax and customs area will not be subject to VAT (Danish VAT). Please also note that, depending on your order and your country, you are under obligation to pay local taxes and fees upon receipt of your order, for which Mustang Sportswear ApS cannot assume responsibility. Refusal to pay such fees will result in the full cancellation of the order. Transport costs and customs clearance costs associated with a cancellation will be deducted from the total amount refunded to you.
Please note that the above delivery times are estimates. Mustang Sportswear cannot be held responsible for delays that arise with GLS.
Items will be delivered to the delivery address specified when ordering. We only deliver to home and business addresses and not to PO boxes. Your item will be delivered on weekdays Monday to Friday. The time of delivery depends on the country in which the delivery takes place and the delivery company used. The items must be signed for upon receipt. You do not necessarily have to be the person to sign for the items. Anyone at the delivery address (e.g. a family member, a friend, receptionist, etc.) can acknowledge receipt with binding effect on you.
Upon delivery, the delivery company will make one delivery attempt. The delivery company will leave a receipt informing you of the details for collection. The delivery company will typically store the item for up to seven (7) days before it is returned to us as undelivered. Please note that our delivery company may also deliver the item to a neighbour if you have agreed to this and if circumstances allow. Please note that you bear the risk of the item after delivery. If the packaging appears to be damaged, you should refuse delivery of the item. If you wish to complain about any defects, you must inform us about this without undue delay. Find out more about this below under ‘Defective and incorrect items’.
If your order consists of multiple items, we reserve the right to make separate deliveries. Separate deliveries may be required if certain items are delayed or not in stock at the time of ordering. You will be informed that your order is subject to separate deliveries. You will not be charged additional delivery costs for separate deliveries.
Please note that items including packages sent by COD, sent to parcel boxes and items/packages that are without postage will not be accepted by Mustang Sportswear or partners who are assumed to handle delivery and receipt of items/packages on behalf of Mustang Sportswear. It should also be noted that Mustang Sportswear or assumed partners do not assume responsibility for items/packages placed at Mustang Sportswear’s or partners’ business addresses.
Please note that shipping costs are payable by the customer for the return of the item or items to Mustang Sportswear. The order includes a return slip to which address the item or items must be returned. The items must be returned to our partner:

DEFECTIVE AND INCORRECT ITEMS
If your purchase is defective or we have delivered an incorrect order, please contact Customer Service by e-mail at email@example.com. If you are already able to ascertain the defect at the time of delivery, you should refuse to take delivery of the item. In the event of a defective or incorrect item, you can return the item and get a refund of the purchase price and all delivery costs once our Customer Service has processed the returned item.
When you contact Customer Service by e-mail, you must state the order number, item number if applicable, and describe what is wrong with the item etc. You are not responsible for costs associated with the return of a defective or incorrect item. We will, of course, refund the purchase price and the original delivery costs once we have received the returned item.
Mustang Sportswear reserves the right to reject complaints about items that have not been handled appropriately or as instructed. If you require help, you are always welcome to contact us at firstname.lastname@example.org.
COPYRIGHT AND TRADEMARK
All content in the web shop, such as, but not limited to, design, text, graphics, logos, videos, images and icons and their composition, software compilations, source code and software are owned by Mustang Sportswear or the suppliers we use. The content is protected by both the Danish Copyright Act and international regulations applicable in this area. It is Mustang Sportswear, or our suppliers, who are the copyright holders of the above.
The content of the web shop may only be copied for your own personal use and never for commercial purposes. Any other use of the information and material from the web shop, such as reproduction, modification, distribution, transmission, copying, display or performance, is strictly prohibited. You may not – except for your own personal use – copy, display, download, distribute, modify, copy, reproduce or reformulate information, texts, documents or other material from the website or any other part of the web shop without the express consent of Mustang Sportswear or our suppliers of the specific materials and information etc.
Trademarks, product names, logos and titles appearing in the web shop are trademarks of Mustang Sportswear or our suppliers. Any reproduction or use of these trademarks constitutes an infringement of the owner’s rights and is strictly prohibited unless for personal use.
UPDATE OF THE WEB SHOP
We do our best to update the web shop and ensure that prices, offers, descriptions and other information about the items are correct. Spelling errors, errors in prices, offers, descriptions and other information about the items may occur, however, and sometimes we find that the price of an item is stated incorrectly. In such case, the error will be corrected as soon as Mustang Sportswear becomes aware of it.
We are not liable for delays or non-compliance with our obligations under these Sales and Delivery Terms and Conditions if the delay or non-fulfilment is due to events beyond our reasonable control.
COMPLETENESS OF AGREEMENT
These Sales and Delivery Terms and Conditions constitute the complete terms of the Agreement between you, who makes a purchase from the web shop, and Mustang Sportswear.
If one or more of the provisions contained in these Sales and Delivery Terms and Conditions should be declared invalid in whole or in part, the remaining provisions will continue to apply.
Mustang Sportswear is entitled to transfer its rights and obligations under this Agreement to a third party. Transfer is conditional on the standard of the service you receive not being reduced. Mustang Sportswear will notify you of any transfer. By accepting these Sales and Delivery Terms and Conditions, you agree to such possible future transfer. You further accept that from the time we notify you of the transfer, your rights can only be asserted against the third party in question.
RIGHT TO COMPLAIN
You are always welcome to contact Customer Service if you wish to complain about a product you have purchased from us. Our Customer Service can be contacted by e-mail at email@example.com.
You can also submit any complaint you may have about an item you have purchased from Mustang Sportswear to the Consumer Complaints Board (Konkurrence- og Forbrugerstyrelsens Center for Klageløsning), Carl Jacobsens Vej 35, 2500 Valby. Complaints can be submitted to the Consumer Complaints Board on their website at:

CHOICE OF LAW AND VENUE
All agreements entered into between us pertaining to these Sales and Delivery Terms and Conditions are subject to Danish law. Disputes that may arise from this Agreement, including the existence or validity of the Agreement, must be brought before a competent court in Denmark.
